4. Indemnification

Liability Limitations and Warranties

5. Disclaimer of Warranties

Our website and services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. DesignCraft disclaims all warranties, including but not limited to:

• Implied warranties of merchantability and fitness for a particular purpose

6. Limitation of Liability

To the maximum extent permitted by applicable law, DesignCraft shall not be liable for:

→ Any indirect, incidental, special, consequential, or punitive damages

→ Cost of procurement of substitute goods or services

In any event, our aggregate liability for all claims shall not exceed the amount you paid to DesignCraft during the six months preceding the claim.

7. Force Majeure

DesignCraft shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials. During such events, our obligations shall be suspended for the duration of the force majeure event.

Legal Framework and Dispute Resolution

8. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Cyprus, without regard to its conflict of law provisions. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

You agree that the courts of Nicosia, Cyprus, shall have exclusive jurisdiction over any disputes arising from or relating to these Terms and Conditions or your use of our services, and you irrevocably submit to the jurisdiction of such courts.

9. Dispute Resolution Procedures

In the event of any dispute, controversy, or claim arising from these Terms and Conditions:

Step 1: The parties shall first attempt to resolve the dispute through good-faith negotiations for a period of 30 days
Step 2: If negotiations fail, the parties may agree to non-binding mediation conducted in Cyprus
Step 3: If mediation is unsuccessful or declined, the dispute may be submitted to binding arbitration or court proceedings in Nicosia, Cyprus

10. Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed from these terms, and the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely approximates the intent and economic effect of the original provision.

11. Entire Agreement

These Terms and Conditions, together with our Terms of Service and Privacy Policy, constitute the entire agreement between you and DesignCraft regarding the use of our website and services. These terms supersede all prior or contemporaneous communications, agreements, or understandings, whether written or oral, with respect to the subject matter hereof.
